Terms & Conditions of Stay

Mergen Bike & Ski Resort · Niedzica Zamek, Pieniny, Małopolska

This is a translation for guests’ convenience. In case of any discrepancy, the Polish version is legally binding.

These Terms & Conditions set out the rules for using Mergen Bike & Ski Resort, operated by Black Apart. Please read them before booking and during your stay. You may also want to check our cabins with the availability calendar.

These Terms & Conditions were prepared on the basis of applicable law and the operator’s established practice.

General provisions

These Terms & Conditions apply to all Guests staying at Mergen Bike & Ski Resort, hereinafter referred to as the "Resort", located in Niedzica Zamek, Łapsze Niżne municipality, Pieniny, Małopolska.

The Resort is operated by Black Apart, with its registered office at ul. Cisowa 5, 34-441 Niedzica Zamek.

Making a booking and checking in at the Resort constitutes acceptance of these Terms & Conditions.

The Resort reserves the right to update these Terms & Conditions. The current version is available on the website and at reception.

Booking and payment

Bookings can be made through the online booking system, by phone, or by email using the operator’s contact details. You can check dates and cabin availability in our booking calendar.

The booking conditions, including the required deposit, its payment deadline and the cancellation rules, are specified individually in each booking confirmation.

Prices shown on the website are indicative. The final price of the stay depends on the chosen cabin, the dates and the length of stay.

The minimum number of nights may vary depending on the season and the chosen unit. Details are provided at the time of booking.

Right of withdrawal

Under Article 38(12) of the Polish Act of 30 May 2014 on Consumer Rights, the statutory right of withdrawal from a distance contract does not apply to accommodation services provided for a specified date (day or period). This means that a booking for a specific stay date at the Resort is not subject to the statutory 14-day right of withdrawal.

The rules for cancelling a booking and refunding a paid deposit are set out in the "Booking and payment" section above, as well as in the conditions specified in each booking confirmation.

Check-in and check-out

Check-in is from 16:00. Check-out should take place by 10:00.

At check-in, the Guest is required to present an identity document and sign the registration card in accordance with applicable regulations.

Early arrival or late departure are possible only after prior arrangement with the operator and may be subject to an additional fee.

Upon receiving the keys, the Guest assumes responsibility for the condition of the cabin handed over and its equipment.

Number of guests and visitors

A cabin may be occupied only by the number of people stated at the time of booking, not exceeding the maximum capacity of the given unit. The full description of capacity, bedrooms and amenities can be found on our cabins page.

Visits by persons who are not registered guests require prior notification to the operator and are permitted only with the operator’s consent.

Organising parties, receptions or gatherings exceeding the number of registered Guests requires separate, written consent from the operator.

Pool, sauna and wellness area

The outdoor pool is open during the summer season: 1 May - 31 October. The full pool regulations (dimensions, hours, rules) can be found on the amenities page.

Only registered Guests of the Resort may use the pool. Children under 16 may use it only under the constant supervision of an adult.

Entering the pool after consuming alcohol or under the influence of intoxicating substances is prohibited. Appropriate swimwear is required in the wet zone. The full pool regulations (dimensions 12 x 6 m, hygiene rules, additional restrictions) can be found on the amenities page.

The sauna and other wellness area facilities are available year-round. The private salt cave in Cabin No. 10 is available exclusively to guests of that cabin, and the private jacuzzi with fireplace in Cabin No. 1 is available exclusively to guests of that cabin.

The operator is not liable for accidents resulting from failure to observe the rules for using the wellness area.

Quiet hours

Quiet hours at the Resort are observed between 22:00 and 7:00.

During this time, Guests are required to keep noise to a minimum and refrain from using loud sound equipment, music or other sources of noise that could disturb the rest of other Guests.

Outdoor grills and bonfires are permitted only outside quiet hours and in designated areas.

Repeated breaches of quiet hours may result in immediate termination of the rental agreement, without the right to a refund of the stay costs.

Pets

The possibility of bringing a pet is arranged individually with the operator before booking.

If a pet is accepted: the Guest takes full responsibility for the animal’s behaviour, any damage it causes, and ensuring its stay complies with applicable veterinary regulations.

Pets must be kept on a leash or under the direct supervision of their owner in the common areas of the Resort. Details (including any applicable fee) are arranged individually.

Parking and resort grounds

Parking spaces directly at the property are available for each cabin. Parking is free of charge and unsupervised.

The Resort grounds are fenced and monitored. Our resort lies in the beautiful surroundings of Niedzica - see the attractions in the Pieniny mountains.

A speed limit of 10 km/h applies on the Resort grounds. Parking in undesignated areas, on lawns and on footpaths is prohibited.

Guest liability

The Guest is financially liable for any damage caused to the cabin, its equipment, or the Resort grounds. The costs of repairing or replacing damaged property are borne by the Guest.

The operator is not liable for the loss or damage of Guests’ personal belongings left on the Resort grounds.

The Guest undertakes to comply with fire safety and general safety regulations. The use of open flames inside the cabin is prohibited.

Complaints

Any comments and complaints regarding the stay should be reported by the Guest to the operator without delay, preferably during the stay.

Complaints should be submitted in writing to the operator’s email address or by post to the registered office address.

Final provisions

In matters not regulated by these Terms & Conditions, the provisions of the Polish Civil Code and other applicable legal acts shall apply.
